How New York calculates it

  • Your base period is the first four of the last five completed calendar quarters; if you qualify, the NYSDOL uses your highest quarter.
  • With wages in all four quarters and a high quarter above $3,575, the weekly rate is the high quarter divided by 26 (lower earners and shorter work histories use slightly different divisors).
  • The rate is bounded by the state minimum and the post-2025 maximum, which now adjusts with the state average weekly wage.
  • Benefits last up to 26 weeks in a benefit year, and partial benefits use an hours-based system — you can work up to 30 hours a week and still receive a reduced check.
  • Certification is weekly, and the first full week of the claim is an unpaid waiting week.
