How to apply
Each order links to its listing on SeasonalJobs.dol.gov, the Department of Labor's official registry, where the employer's recruitment contact and the full job description are published. U.S. workers can apply directly to the employer or through their state workforce agency, which refers applicants to these orders; H-2A employers must keep hiring qualified U.S. applicants until half of the contract period has passed.
Your rights on an H-2A job
- Housing at no cost for workers who cannot reasonably return home each day; if the employer uses rental housing, it pays the landlord directly.
- Meals: three meals a day at no more than the charge the DOL sets, or free kitchen facilities to cook your own.
- Free daily transportation between employer housing and the worksite.
- Travel: inbound transportation and meals are reimbursed once you complete 50% of the contract (if not advanced earlier), and the return trip is paid when the contract ends.
- Three-fourths guarantee: work for at least 75% of the hours in the contract period, or pay for the difference.
- Tools and equipment the job requires, and workers' compensation insurance, at no cost.
- A written contract (or a copy of the job order) in a language you understand.
- No fees: the employer and its agents cannot charge you for recruitment, the application or attorneys, and cannot keep your passport.
